Notice of Intent to Award a Sole-Source Contract Subject: Notice of Intent to Award a Sole-Source Contract for Post Construction Award Services (PCAS) for the Caserma Miotto Storm and Sanitary Project. Agency: 414th Contracting Support Brigade (CSB), Regional Contracting Office (RCO) Vicenza, Italy. Description: The 414th CSB intends to negotiate and award a sole-source contract to A.I.C.E. Consulting Srl for the provision of Title II / Post Construction Award Services (PCAS) for the Caserma Miotto Storm and Sanitary Project in Longare, Italy. Description of Services: The required services include comprehensive construction oversight to ensure the project is executed in strict accordance with the original design specifications. This includes, but is not limited to, conducting on-site inspections, reviewing and approving technical submittals from the construction contractor, responding to Requests for Information (RFIs), resolving unforeseen site conditions, and providing final certification of the completed works. These services are critical for ensuring the quality, safety, and compliance of a major infrastructure project. Statutory Authority: This action is being executed on a sole-source basis under the authority of 10 U.S.C. § 3204(a)(1), as implemented by Federal Acquisition Regulation (FAR) 6.103-1 "Only one responsible source and no other supplies or services will satisfy agency requirements." Justification for Sole-Source Award: A.I.C.E. Consulting Srl is the original Designer of Record (DoR) for the Caserma Miotto Storm and Sanitary Project. Under established engineering protocols and federal procurement guidelines, awarding the follow-on PCAS contract to the DoR is essential for the following reasons: Continuity of Knowledge: As the DoR, A.I.C.E. possesses unique, proprietary, and non-transferable technical familiarity with the complex engineering calculations, site-specific design adaptations, and overall design intent. Only the DoR can seamlessly provide the required oversight without introducing significant risks. Prevention of Substantial Duplication of Costs: Awarding this contract to any other firm would legally require the new entity to conduct an exhaustive, independent review and re-validation of the entire original design in order to assume professional liability. This would force the Government to pay a second time for engineering analysis already performed, representing a substantial duplication of cost that is not expected to be recovered through competition. Avoidance of Unacceptable Delays: The construction phase of this project is imminent. A new competitive action would require a minimum of 120 days for procurement, plus additional weeks or months for a new firm to familiarize themselves with the design. Such a delay would halt a critical $12.4M life-safety project, leaving failing infrastructure exposed and resulting in serious harm to the Government's mission. Therefore, the Government has determined that A.I.C.E. Consulting Srl is the only responsible source capable of performing these highly specialized services without causing unacceptable delays and a substantial duplication of costs. Instructions to Interested Parties: This Notice of Intent is not a request for competitive proposals. However, all responsible sources who believe they can meet the Government's requirements as the Designer of Record may submit a capability statement. A determination by the Government not to compete this proposed action is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government.
