This is a Notice of Intent for the Government to award a definitive contract to Penlink on behalf of the Bureau of International Narcotics and Law Enforcement Affairs (INL). This contract will provide an Advanced Digital Analysis Platform and Technology Product (ADAPT) that will be donated to Government of Mexico Attorney General’s Office, Technical Control Unit (UCTC) for use as their Digital Legal Interception System. This sole source contracting action is being pursued pursuant to FAR 6.103-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This notice constitutes a synopsis of the proposed contract action and is not a request for competitive quotations. Interested parties may submit a capability statement demonstrating their ability to meet the Government’s requirements as described in the draft Statement of Work (SOW). Responses must provide sufficient detail for the Government to evaluate the vendor’s technical capability, interoperability, deployment approach, and operational suitability. In addition, responses should address whether the proposed solution is interoperable with the PenLink PLX Platform currently used by U.S. government agencies to facilitate sharing digital evidence and intelligence. Responses must also demonstrate that interested vendors have a notional or actual business approach that permits the full array of required services to be legally performed by appropriately licensed entities within Mexico. All responses received by the deadline identified in this notice will be considered by the Government. A determination regarding whether a competitive procurement is feasible will be made solely at the discretion of the Government based on the information received. If no affirmative responses are received that demonstrate a capability advantageous to the Government and consistent with the operational requirements identified in the draft SOW, the Government intends to negotiate solely with PenLink. Responses must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder the mission objectives described in the draft requirements document. The Government will not be responsible for any costs incurred in responding to this notice.
