Notice of Intent to Sole-Source: The 4th Contracting Squadron at Seymour Johnson AFB, NC intends to award a non-competitive firm fixed priced purchase order to Thomas Electronics, Inc. The requirement is for Cathode Ray Tubes that adhere to the existing F3I parent assembly constraints. The specified part is identified as Part Number 08M352P43. The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and RFO Part 12.102(a). The original equipment manufacturer, Thomas Electronics, retains full intellectual property (IP) rights for the design and manufacturing of Part Number 08M352P43. As a result of these proprietary rights, Thomas Electronics is the sole source supplier to Air Force and other government-contracted entities. Comprehensive market research was conducted to identify alternative sourcing avenues. This investigation confirmed that no other manufacturers produce a compatible unit. Furthermore, an exhaustive search for suitable substitute part numbers yielded no viable alternatives. Thomas Electronics was identified as the only supplier capable of fulfilling this requirement. Procurement must be directed to Thomas Electronics on a sole-source basis. This is because Thomas Electronics is the only responsible source, and no other type of supplies will satisfy the agency's requirements due to the proprietary nature of the required part. The manufacturer's intellectual property rights prevent the development and sourcing of alternative parts from other suppliers. To address the long-term constraints of this sole-source situation, we will continue to invest in monthly sustainment efforts. These efforts will include working closely with the Systems Program Office and WRALC/WAQ to explore and refine potential alternative avenues for future procurement. THIS IS NOT A REQUEST FOR COMPETITIVE OFFERS, and a solicitation will not be issued. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. If no affirmative written response is received, the award will be made without further notice. Oral communications are not acceptable in response to this notice.
