The Commercial Solutions Opening (CSO), authorized under 10 USC 3458 as revised by the 2026 National Defense Authorization Act Section 1823) is not a Request for Quotations one would normally expect to see from federal Government contracting offices. We (Delaware Army National Guard, also referred to as “the Government”) are seeking an optimal, innovative, commercially available solution to our problem set as stated in CSO Section 2.0 Problem Statement and Section 3.0 Desired System Attributes and Capabilities. We do not have a particular floor layout nor pre-determined pallet rack design. Given the amount of equipment (displayed during the site visit) that we need to store on either pallet racks or in secure storage, we don’t need to maximize cube in this storage building. We are looking for an optimal solution based on technical merit, company expertise, and pricing, as indicated in the CSO. The Section 4.0 Phase 1 Submission Process calls for, among other things, a recommended contract line item structure and preliminary pricing. Upon receipt and review of the proposed solutions and preliminary break-out by line item pricing, the Government will determine whether the construction portion of this project is substantial and segregable to rise to the level as to requiring a Davis-Bacon and Related Acts Wage Determination, consistent with RFO FAR Subpart 22.4 Labor Standards for Contracts Involving Construction. If applicable, the Wage Determination DE20260008 Mod #1, is the most likely wage determination to be provided to those vendor(s) invited to participate in Phase 2 Negotiation for purposes of negotiating a firm-fixed price FAR-based purchase order.
