FBO ANNOUNCEMENT: PRESOLICITATION NOTICE, NOTICE OF INTENT ACTION CODE: SPECIAL NOTICE SUBJECT: Sole source – Maintenance Agreement for a Joel Dart Mass Spectrometer SOLICITATION NUMBER: NB643050-26-01694 RESPONSE DATE: 8/29/26 DESCRIPTION: The National Institute of Standards and Technology (NIST), Surface and Trace Chemical Analysis Group (STCAG) of the Materials Measurement Science Division (MMSD) of the Materials Measurement Laboratory (MML) has significant research efforts in the fields of forensic science and homeland security. One of the major foci of these efforts surrounds development, evaluation, and quantification of real-world illicit drug samples through our Rapid Drug Analysis and Research (RaDAR) program. To enhance the capabilities of the STCAG and the Materials Measurement Science Division (MMSD) as a whole, the STCAG heavily utilizes a Direct Analysis in Real Time (DART) system that is coupled to a JEOL JMS-T100LP ACCUTOF LC-PLUS Mass Spectrometer. This system requires annual maintenance to avoid down time and costly repairs and ensure our ability to continue to support critical partnerships through the RaDAR program. In addition, this service contract will allow us to maintain the high level of sensitivity and repeatability needed for these types of measurements. The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR Part 12.102(b) with Jeol USA located in Peabody MA, for this maintenance. Sole Source justification is based on the following: Market research has shown that Joel USA , is the only known authorized source for maintenance and support for this equipment. Joel has stated in writing “JEOL USA, INC. and its subsidiary JEOL Canada are the sole factory authorized provider of service and sales in the United States and Canada. Engineers return periodically to the JEOL Training Center for additional training whenever new equipment or new techniques are introduced. Factory training and JEOL training center instruction in maintaining JEOL instrumentation are available only to current, qualified JEOL Service Engineers.” NAICS code for this requirement will be 811210– Electronic and Precision Equipment Repair and Maintenance with a small business size of $34.0M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 1:00AM EST on 8/29/26 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
